    OMG…Jilin’s contempt is completely justified. DXY is really stupid and Linhui is just as stupid to favor such stupid lawyer. She is a lawyer for god sake and representing a corporate at that and she doesn’t even know the basic principle in labor law in general?
    Yes, discrimination towards women is real especially based on potential maternity leave they might take..however as the term stated, it’s “discrimination” so it’s not legal thing on paper, and as a lawyer what she needs to pay attention especially is the legal side of the matter.
    HR doesn’t hire a woman based on her personal status and body condition is something that should only be done under the table, so…it’s not something to be put on the table as a legal ground for hiring/firing a worker.
    Shortly to say, one can’t simply not acknowledging a job contract just based on the ground that a worker is concealing her personal status like a marriage, having children or pregnancy nor even her actual age… because those things are not directly related to the competency required for the job.
    Her concealongbpregnancy status would only be possible to be used as a legal ground to dismissal if the job she takes are especially requiring not pregnant women to do it, for example: X-Ray Maschine operator, chemical laboratory staff which is handling stuffs with high radiation, extreme sport trainer, special force soldiers, stunt in for extreme scenes or something similar which definitely requiring non pregnant woman…or if it’s obviously stated in the contract that the personal are prohibited for marriage and pregnancy for a certain period.
    But it’s obviously not the case here.
    Dai Xing is working for an administrative position which can normally be done by any pregnant woman… And concealing her personal health situation is in fact her privacy right from the legal side of viewpoint.
    From legal POV, she can even decline to answer her actual age if she wanted to.
    So this is not a legal argument for a dismissal…
    Duxinyi is really not qualified enough as a lawyer if she can’t even remember this fact.
    As a lawyer, she can’t use this concealment of pregnancy as a main argument to win the case.
    She should have found another argument.
