      I think one should simply judging the strategy based on the circumstances whether litigation or fighting at court is the better solution.
      Considering the cost effectiveness is not wrong at all if the standing is not so good.

      Although JL has very valid points about companies but I think it’s a bit narrow-minded to compare low level employees who are working to ensure their basic needs are met to upper management who are pushing for profits to enrich themselves more (they aren’t setting up welfare programs for their employees or society with it). Also he’s also diminishing the work of low level employees by lamenting about the struggles of ceos as if in this case, the factory workers aren’t giving up the health of their bodies to work. Many of them will have severe back and joint problems from working so hard to help the ceo achieve his dreams long after they’ve stopped working. So if we can’t feel sorry for the employees then we definitely can’t feel sorry for the ceo. Everyone is trying to make a living rich or poor so these things must be examined case by case. If we only followed companies and their profit logic, there would be no safety laws in the workplace and people would just have to starve once they outworked their usefulness.

      As for BDD, I don’t understand how she’s been working this long in law and her mind hasn’t been thinking in that of her opponents. I would think this is something you’d practice in law school so that you cover all your bases. I think she should really internalize some of what JL says. She doesn’t have to believe it but she needs to understand it.
